I'm a little confused. If he shot them in their backs, how in the world did he convince the jury that he felt he was threatened?

I mean, okay, if I have a bead on you with a shotgun, and you STILL advance, as if you don't believe I will shoot....yeah, that's pretty clear that they are threatening.

But, surely after he shot the first guy in the back (indicating he was running away already?), he kills the other guy, as well???

Not only that, but he flat-out told the dispatcher he intended to kill. Not to stop. Not to scare off. Not to warn. To kill.

Something doesn't add up for me.

Texas. Go figure.

I know that it is allowed under Texas law, so my opinion is moot, but my opinion is that it is murder.
Not even mentioning the fact that he had no way of knowing whether or not they were illegal, which makes the point moot.

I consider what the man did to be murder, plain and simple. First of all he could have hit legs not theoractic area.

More backseat shooting from the ignorant. Even IF it made sense to aim for the legs in a gunfight (it doesn't, they're harder to hit when sober, let alone when adrenaline is pumping), a 12 ga. shotgun loaded with 00 is going to do so much damage that the guy shot in the leg (as you suggest) is going to bleed out within about a minute. He still dies, and you risked missing your target and hitting an innocent person for NOTHING.

To use a shotgun effectively:

1. Shoulder weapon into the crease of your shoulder while pressing your cheeck against the stock.

2. Align bead-sight with that which you intent to kill.

3. Aim for center-mass and pull the trigger.

Easy peasy, gets the job done.
