I don't actually see the problem here. The guy took the child into his house and got the boys mothers phone number from him. She was alerted to the situation and then called the police to say her some was being held by some man.

Where the police not supposed to follow due process ? Where they just meant to ignore such a call ?

And this quote from the guy kinda makes it obvious that there were indeed grounds for a charge of assualt.

Thanks for the quote supporting evidence of assault. The problem is Joe that the man took the boy into his house against his will. That means he surpassed his rights of a citizens arrest and actually committed a very serious crime himself that being false imprisonment. Again something obviously happened if there was subsequent che of assault.
