You can punish the guilty without 'taking' a life. You can throw someone under the jail and lose the key. Your argument is silly and illogical that 'government would shut down' without capital punishment. Capital punishment was 'unconstitutional' for awhile (IIRC in the 70's) and government didn't shut down.
The government merely makes laws, and has a duty to enforce them. It is the person who breaks the law that is responsible for what happens next.

The guy who built the bridge isn't responsble to the guy who jumps off of it.
