The idea of legal effect has within it the notion of compulsion. If parties come to a consensus using a mediation mechanism whether it be Sharia or Halakah or an arm wrestle across the table in the pub then enforcement isn't required. The important point is that the consensus reached must be within the bounds of secular law. Phillips LCJ made that point clearly.
